The following terminology applies to these Terms and Conditions and any or all Agreements: "Customer" and "Customers", refers to you, the person accessing this website and accepting the company's terms and conditions. "The company", refers to myFITBOX which is wholly-owned by Nietorp Sdn Bhd (company registration no: 201901035172 [1344502 - A]). "Parties" or "Party", refers to both the customer and myFITBOX, or the customer or myFITBOX. All terms refer to the offer, acceptance and consideration of payment necessary to undertake the process of our assistance to the customer in the most appropriate manner, whether by formal meetings of a fixed duration, or any other means, for the express purpose of meeting the customer's needs in respect of provision of the company's stated services/products, in accordance with and subject to the prevailing Malaysian Law. Any use of the above terminology or other words in the singular, plural, capitalisation and/or/ he/she/ or they, are taken as interchangeable and therefore as referring to the same.
myFITBOX reserves the right to change, modify, add, or remove portions of these Terms and Conditions at any time. Changes will be effective when posted on the myFITBOX website with no other notices provided and you are deemed to be aware of and bound by any changes to the foregoing upon their publication on www.myfitbox.co.
Acceptance of Terms
This Agreement contains the complete terms and conditions that apply to customers on the myFITBOX website. The customer who wishes to use the site including its tools and services are advised to read the terms of use carefully. By accessing this site or using any part of the site or any content or services hereof, the customer agrees to become bound by these terms and conditions.
Registration Information
To complete the sign-up process on the myFITBOX website, the following must be provided; full legal name, current address, a valid email address, member name and any other information needed in order to complete the sign-up process. The customer must be 18 years or older and must be responsible for keeping the password secure, and contents that are uploaded. Any information provided by the customer or gathered by myFITBOX or third parties during any visit to the site shall be subject to the terms of www.myfitbox.co Privacy Policy.
Terms
This Agreement will remain in full force and effect while the customer is on the www.myfitbox.co website. Newsletter subscription may be terminated at any time for any reason by emailing to info@myfitbox.co. Even after subscription is terminated, certain sections of this Agreement will remain in effect.
Intellectual Property Rights
The customer hereby acknowledges that all rights, titles and interests, including but not limited to rights covered by the Intellectual Property Rights, in and to the site, and that the customer will not acquire any right, title, or interest in or to the site except as expressly set forth in this Agreement. The customer will not modify, adapt, translate, prepare derivative works from, decompile, reverse engineer, disassemble or otherwise attempt to derive source code from any of our services, software, or documentation, or create or attempt to create a substitute or similar service or product through use of or access to the Program or proprietary information related thereto.
Confidentiality
The customer agrees not to disclose information obtained from myFITBOX and/or from other customers, advertisers, suppliers and forum members. All information submitted by an end-user customer pursuant to the website is proprietary information of myFITBOX. Customer information is confidential and may not be disclosed. myFITBOX agrees not to reproduce, disseminate, sell, distribute or commercially exploit any such proprietary information in any manner.
Waiver
Failure of myFITBOX to insist upon strict performance of any of the terms, conditions and covenants hereof shall not be deemed a relinquishment or waiver of any rights or remedy that myFITBOX may have, nor shall it be construed as a waiver of any subsequent breach of the terms, conditions or covenants hereof, which terms, conditions and covenants shall continue to be in full force and effect.
Severability of Terms
In the event that any provision of these Terms and Conditions is found invalid or unenforceable pursuant to any judicial decree or decision, such provision shall be deemed to apply only to the maximum extent permitted by law, and the remainder of these Terms and Conditions shall remain valid and enforceable according to its terms.
Entire Agreement
This Agreement shall be governed by and construed in accordance with the substantive laws of Malaysia, without any reference to conflict-of-laws principles. The Agreement describes and encompasses the entire agreement between myFITBOX and the customer, and supersedes all prior or contemporaneous agreements, representations, warranties and understandings with respect to the Site, the contents and materials provided by or through the Site, and the subject matter of this Agreement.
Choice of Law; Jurisdiction; Forum
Any dispute, controversy or difference which may arise between the parties out of, in relation to or in connection with this Agreement is hereby irrevocably submitted to the exclusive jurisdiction of the courts of Malaysia, to the exclusion of any other courts without giving effect to its conflict of laws provisions or your actual state or country of residence.
Placement of Orders
1.1 Any order that has been placed are subjected to delivery capability, product availability and acceptance by myFITBOX.
1.2 Certain products may be only suitable for certain kinds of diets. The customer must cross reference the nutritional facts of the product with his or her diet preference before making an order. myFITBOX is not liable for any health complications that arise from the consumption of products that conflict with the dietary preference and/or limitations.
Payment and Prices
1.1 All product prices listed on the website is the final price of listing at that given time. myFITBOX reserves the rights to change and amend these price lists.
1.2 Product purchase(s) can only be made via bank transfer on the myFITXBOX website.

Indemnification
You agree to indemnify, defend and hold harmless myFITBOX and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns and employees, harmless from any claim or demand, including reasonable attorneys’ fees, made by any third-party due to or arising out of your breach of these Terms of Service or the documents they incorporate by reference, or your violation of any law or the rights of a third-party.
